TERMS OF SERVICE
Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using www.revivewellnessclub.ca (the “Website”) operated by Revive Wellness Club Ltd. (“Revive Wellness,” “us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of our Website at www.revivewellnessclub.ca.
By using or accessing this Website in any way, including but not limited to browsing, visiting, or contributing content or materials, you agree to be bound by these terms and conditions. Terms defined herein shall have the same meaning throughout this agreement. These terms outline the legally binding conditions for your use of Revive Wellness services. You may only utilize these services if you agree to comply with all applicable laws and these terms. Please review this agreement carefully. If you do not agree, you must immediately exit the Revive Wellness website and cease using its services. To become a customer, you must read and accept these terms as part of the registration process.
ELIGIBILITY
You must be at least 18 years of age or accompanied by a parent or legal guardian to use the services offered by Revive Wellness. If you are under the age of 18, you require written permission from a parent or legal guardian, who must also sign and accept our liability waiver on your behalf.
SERVICES
SERVICES: As a member or drop-in customer of Revive Wellness you are permitted to use the services offered by Revive Wellness, including contrast therapy, which involves alternating between ice baths and saunas, for the duration of each scheduled session, typically lasting one hour. By using these services, you acknowledge and accept the inherent risks involved, including but not limited to the potential for discomfort, dizziness, dehydration, or other health-related reactions due to exposure to extreme temperatures.
WAIVER: Before accessing any services, you are required to sign a liability waiver, acknowledging your understanding of these risks and agreeing to release Revive Wellness and its affiliates from any liability related to your participation in contrast therapy or other services. This waiver must be signed prior to the start of any session
Revive Wellness reserves the right to refuse service to individuals who are not in compliance with these terms or who, in the sole discretion of the staff, may present a health or safety risk.
Additionally, all users must comply with any other rules or regulations set forth by Revive Wellness for the use of its facilities, including any changes made to this Agreement.
MEMBER SERVICES AND POLICIES
MEMBERSHIP FEES: By enrolling in a membership program offered by Revive Wellness, you agree to pay the membership fees as outlined on our website or communicated to you at the time of registration. Fees are charged on a monthly basis and are due in advance, unless otherwise specified. All membership fees must be paid using the payment method provided during registration. You authorize us to automatically charge your account for the membership fees on the due date, unless you notify us in writing of any changes to your payment method.
FEE CHANGES: We reserve the right to adjust membership fees at any time. Any changes to the fee structure will be communicated to you in advance. If you do not agree with the new fees, you may cancel your membership before the new fee takes effect.
LATE/NON-PAYMENT: If payment is not received when due, as determined by Revive Wellness, we may suspend or cancel your membership until payment is received at our sole discretion.
MEMBERSHIP FREEZES: You are eligible to request 3 membership freezes of 30 days for every 12 months of membership, with a maximum of 1 freeze allowed within a 1-month period, starting from your membership activation date. Your membership start date is the date you enrolled. To request a freeze, please contact us at [email protected].
TRIAL PERIOD / DISCOUNTS: Any trial period or promotional discount applies only to the initial term of the membership. After the trial or discount period ends, the standard membership fees will apply, and you will be automatically billed at the regular rate.
ACCOUNTS
To access certain features of the website, you will need to create a Revive Wellness account. You are prohibited from using another person's account without their permission. When setting up your account, you must provide accurate and complete information. You are solely responsible for all activity that occurs under your account and must ensure that your account password remains confidential. If you suspect any unauthorized access to your account, you must notify us immediately.
The creation of multiple Revive Wellness accounts, including those with different names, email addresses, phone numbers, or physical addresses, is strictly prohibited. Revive Wellness reserves the right to merge such accounts without notice. If duplicate accounts are used to exploit promotions or offers not available to the account holder under normal circumstances, the full value of the services received may be charged without prior notice.
REVIVE RULES AND REGULATIONS FOR MEMBERS AND DROP-IN CUSTOMERS
CLUB FACILITIES: Revive Wellness may make certain toiletries and amenities available for use by customers who have purchased services. These items are not to be removed from the premises and should only be used within reason. Tampering with equipment, such as thermostats and sauna controls, is prohibited.
ATTENDANCE: You must be physically present and checked in at the start of your session or your spot may be released to another customer. You must check in prior to your session start time at the front.
CANCELLATION POLICY: If you need to cancel your session, you must do so at least 24 hours in advance. Failure to cancel within this timeframe may result in a late cancellation fee of $45 being applied to your account. You can cancel online or by phone. RESERVATIONS: You must be physically present and checked in at the start of your scheduled session or your reserved session may be given to another customer.
SAUNAS: To use the saunas, you must be at least 13 years old. A shower is required before entering the sauna. Pouring water on any part of the sauna is prohibited. Food and beverages are not allowed inside, and personal items should not be dried in the sauna. Due to the high temperatures, sauna use may pose health risks. It is advisable to consult a physician before using the sauna, particularly if you have conditions such as high blood pressure, heart disease, respiratory issues, or if you are pregnant, as high heat exposure may not be safe.
LOCKERS: Lockers are for day use only. Any items left in lockers overnight may be placed in the lost and found or donated to charity.
CONDUCT: You are expected to conduct yourself in a professional and respectful manner while using the services. Any inappropriate or disruptive behaviour may result in immediate termination of your use of the services.
PERSONAL BELONGINGS: At no time shall Revive Wellness be responsible for the safekeeping of your personal belongings while you are on our premises and/or using our facilities and services. You agree to assume any and all risk of loss for any of your personal belongings.
REFUND POLICY
DROP-IN SESSIONS: You understand and accept that all drop-in sessions are non-refundable, with no exceptions.
MEMBERSHIP: All membership packages are non-refundable. No exceptions. Monthly memberships can be canceled anytime by contacting us via email, or in person at the club.
PRIVACY
By submitting your personal information and using our Website, you consent to the collection, use, reproduction, hosting, transmission, and disclosure of any such user content submissions in compliance with this privacy policy as we deem necessary for use of the Website and provision of services.
By using this Website you are consenting to the use of cookies which allow a server to recall previous requests or registration and/or IP addresses to analyze website use patterns. You can set your browser to notify you before you receive a cookie, giving you the chance to decide whether to accept it. You can also set your browser to turn off cookies. If you do, however, some areas of the Website may not function adequately.
THIRD PARTY WEBSITES
For your convenience, this Website may provide links or pointers to third-party sites. We make no representations about any other websites that may be accessed from this Website. If you choose to access any such sites, you do so at your own risk. We have no control over the contents of any such third-party sites and accept no responsibility for such sites or for any loss or damage that may arise from your use of them. You are subject to any terms and conditions of such third-party sites.
Our Website must not be framed on any other site, nor may you create a link to any part of our Website other than the homepage. We reserve the right to withdraw linking permission without notice. The website in which you are linking must comply in all respects with the Conditions of Use and User Submissions and Site Content Standards. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Revive Wellness, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms and Conditions or your use of the Website, including, but not limited to, your User Submissions, third-party sites, any use of the Website's content, services, and products other than as expressly authorized in these Terms and Conditions.
GOVERNING LAW AND CHOICE OF FORUM
The Website and these Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision, principle, or rule (whether of the laws of the Province of Ontario or any other jurisdiction) and notwithstanding your domicile, residence, or physical location.
Any action or proceeding arising out of or relating to this Website and under these Terms and Conditions will be instituted in the courts of the Province of Ontario and/or the Federal Court of Canada, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such action or proceeding.
You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts.
WAIVER
The Website and these Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision, principle, or rule (whether of the laws of the Province of Ontario or any other jurisdiction) and notwithstanding your domicile, residence, or physical location.
WAIVER
No failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms and Conditions operates, or may be construed, as a waiver thereof; and no single or partial exercise of any right, remedy, power, or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.
SEVERABILITY
If any term or provision of these Terms and Conditions is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.
ENTIRE AGREEMENT
These Terms and Conditions, our Privacy Policy, and any Waiver you sign/accept constitute the sole and entire agreement between you and Revive Wellness regarding the Website and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding such subject matter.
